- Demand payment – Known as “Demand”:
This does not mean you need to threaten or be hostile with the Debtor, you need to be clear that the money is owing, due and payable and payment needs to be made immediately or the Debtor needs to enter into a payment arrangement. Being persistent is key.
- Determine when to institute action against the Debtor – Known as “When”:
Deciding when to take action is crucial. It must also be taken into consideration that leaving the account to go severely into arrears makes it more difficult to collect the money outstanding.
- Handover – Known as “Who”:
Ensure that your matters are handed over to Alan Levy Attorneys without further delay. We will commence action by sending out a Letter of Demand (S129) giving the Debtor notice that payment must be made immediately.
- Legal Action – Known as “Where”:

- Legal Action – Known as “How”:
Unfortunately, some Debtors are extremely difficult and refuse to pay money over that is owed by them. We will then take your matter to Court where we will proceed to expedite the matter to attach movable property to sell via Sheriff’s Auction. Should the sale not be sufficient to cover the debt and if there is no signed arrangement in place, we will then proceed to sell immovable property belonging to the Debtor.
